Affiliate Terms & Conditions

1.1 Definitions

In these Affiliate Terms: "eSimHero", "we", "us", or "our" refers to eSimHero and its operators. "Affiliate", "you", or "your" refers to the individual or entity accepted into the Program. "Customer" refers to any end user who purchases an eSIM plan through eSimHero. "Referred Customer" refers to a Customer whose purchase is attributed to you through the Program's tracking mechanisms. "Commission" refers to the monetary amount earned by you for qualifying Referred Customer purchases.

1.2 Agreement to Be Bound

If you do not agree to these Affiliate Terms in their entirety, you must not participate in the Program, use your referral link, or access the affiliate API. Your continued participation in the Program after any modifications to these terms constitutes acceptance of the revised terms.

2.1 Requirements

To be eligible for the Program, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have a valid eSimHero user account
• Provide accurate and complete information during the enrollment process, including your legal name and contact email
• Comply with all applicable laws and regulations in your jurisdiction

2.2 Acceptance & Account Setup

eSimHero reserves the right to accept or reject any affiliate application at its sole discretion, without providing a reason. Upon acceptance, your user account will be linked to your affiliate profile. You will receive a unique affiliate slug, referral link, and API key. Your API key is shown only once at the time of creation — you are solely responsible for storing it securely. If your key is lost or compromised, contact us to have it revoked and replaced.

2.3 Account Responsibility

You are responsible for all activity that occurs under your affiliate account. You must not share your API key with any third party, and you must immediately notify eSimHero if you suspect any unauthorised access to your account or API key.

3.1 Commission Rates

Your commission rate (expressed as a percentage of the order total) is set at the time of enrollment and may be adjusted by eSimHero with prior notice. Where applicable, a minimum commission amount per qualifying sale may also be configured — in such cases, you will earn whichever is greater: the percentage-based commission or the minimum commission amount.

3.2 Qualifying Purchases

A commission is earned only when a Referred Customer completes a qualifying purchase. A qualifying purchase is one that:

• Is successfully paid for and fulfilled (eSIM provisioned)
• Is attributed to you through the Program's tracking mechanisms
• Is not subsequently refunded, charged back, or identified as fraudulent
• Is made by a genuine third-party customer (not by you or your household members)

3.3 Holdback Period

All commissions are initially placed in a "pending" status. Commissions become eligible for approval after a 30-day holdback period from the date of the original order. This holdback period exists to account for potential refunds, chargebacks, or fraud detection. eSimHero reserves the right to adjust the holdback period with prior notice.

3.4 Approval & Payment

After the holdback period, pending commissions are reviewed and either approved or rejected by eSimHero. Approved commissions will be paid out according to a schedule and payment method determined by eSimHero. eSimHero reserves the right to reject any commission if the underlying order is found to be fraudulent, refunded, or otherwise in violation of these terms. You are solely responsible for any tax obligations arising from your commission earnings.

4.1 Tracking Mechanism

When a potential customer clicks your referral link (containing your unique affiliate slug via the "ref" or "utm_source" URL parameter), a first-party cookie ("esh_aff") is set in their browser. This cookie is HTTP-only, uses the SameSite=Lax attribute, is secured on HTTPS connections, and has a maximum lifespan of 30 days.

4.2 Attribution Window

The attribution window is 30 days from the date the tracking cookie is set. Any qualifying purchase made by the customer within this 30-day window will be attributed to you, provided no other affiliate's cookie or attribution takes priority. After 30 days, the cookie expires and subsequent purchases will not be attributed to you unless the customer clicks your referral link again.

4.3 First-Touch Attribution

The Program uses a first-touch attribution model. If a customer already has an existing affiliate tracking cookie, clicking a different affiliate's referral link will not overwrite the original cookie. The first affiliate to refer the customer retains attribution for the duration of the cookie's lifespan.

4.4 Attribution Priority

When a purchase is made, attribution is determined in the following priority order:

• Discount code: If the customer uses a discount code linked to a specific affiliate, that affiliate receives attribution regardless of any cookie
• Cookie: If no affiliate-linked discount code is used, the affiliate identified by the tracking cookie receives attribution
• User account link: If no cookie or discount code attribution applies, and the customer's account has been previously attributed to an affiliate (through a prior cookie-based purchase), that affiliate receives attribution as a lifetime link

4.5 Limitations

Attribution relies on cookies and browser behaviour, which eSimHero does not fully control. Customers who clear their cookies, use private browsing, switch devices, or block cookies may not be attributed to you. eSimHero is not responsible for lost attribution due to customer browser behaviour or technical limitations.

5.1 Referral Link

You will receive a unique referral link containing your affiliate slug. You may share this link on your website, social media, email newsletters, and other legitimate marketing channels. You must not modify the referral link structure in any way that could interfere with the tracking mechanism.

5.2 API Access

You will receive an API key that provides access to eSimHero's affiliate API endpoints, including the product catalogue and destination links endpoints. The API is provided for the purpose of integrating eSimHero's product offerings into your website or application to promote eSimHero's services.

5.3 API Key Security

Your API key must be treated as a confidential credential. You must not share your API key with any third party, embed it in client-side code where it could be exposed, or use it in any manner that could compromise its security. If your API key is compromised, notify eSimHero immediately.

5.4 Acceptable Use

You agree to use the API in a reasonable manner. Excessive requests, automated scraping for purposes unrelated to promoting eSimHero, or any use that places undue burden on our infrastructure may result in rate limiting, temporary suspension, or permanent revocation of your API access.

7.1 Permitted Use

You may use eSimHero's name and logo on your website, social media, and marketing materials in connection with your participation in the Program, provided that such use accurately represents the eSimHero brand and does not disparage or bring the brand into disrepute.

7.2 Restrictions

You must not:

• Alter, distort, or modify eSimHero's trademarks, logos, or brand assets in any way
• Create domain names, social media handles, or other identifiers that include eSimHero's trademarks or could cause confusion with official eSimHero properties
• Imply an endorsement, partnership, or employment relationship with eSimHero beyond your role as an affiliate
• Use eSimHero's intellectual property in any manner that is illegal, defamatory, or otherwise objectionable

7.3 Brand Guidelines

eSimHero may from time to time provide brand guidelines or approved marketing assets. Where such guidelines are provided, you must comply with them. eSimHero reserves the right to request modifications or removal of any content that uses its intellectual property in a manner that does not comply with these terms or any applicable brand guidelines.

8.1 Termination by You

You may terminate your participation in the Program at any time by contacting eSimHero. Upon voluntary termination, any approved but unpaid commissions will be paid out in accordance with the standard payment schedule.

8.2 Termination by eSimHero

eSimHero may terminate your participation in the Program at any time, with or without cause. In cases of termination for cause (including violation of these Affiliate Terms, fraud, or illegal activity), eSimHero may immediately deactivate your affiliate account and API key, and all pending and approved but unpaid commissions may be forfeited. In cases of termination without cause, approved but unpaid commissions will be paid out in accordance with the standard payment schedule.

8.3 Effect of Termination

Upon termination, you must immediately cease using your referral link, API key, and all eSimHero intellectual property. Your API key will be deactivated and your affiliate dashboard access will be revoked. Any attribution cookies already set in customers' browsers will continue to function until their natural expiry, but no new commissions will be generated after termination.

9.1 Program Provided "As Is"

The Program, including the affiliate dashboard, API, tracking systems, and all related tools, is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 No Guaranteed Earnings

eSimHero makes no representations or guarantees regarding the amount of commission you may earn through the Program. Earnings depend on numerous factors outside eSimHero's control, including the volume and quality of traffic you generate, customer purchasing behaviour, and market conditions.

9.3 Limitation of Liability

To the maximum extent permitted by applicable law, eSimHero shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your participation in the Program. eSimHero's total aggregate liability to you for any claims arising under these Affiliate Terms shall not exceed the total commissions actually paid to you in the twelve (12) months preceding the event giving rise to the claim.

9.4 Changes to the Program

eSimHero reserves the right to modify any aspect of the Program at any time, including but not limited to commission rates, attribution windows, holdback periods, API functionality, and payment schedules. Material changes will be communicated to you with reasonable notice. Your continued participation in the Program after such changes constitutes acceptance.

10.1 Modifications to These Terms

eSimHero may update these Affiliate Terms from time to time. When material changes are made, we will notify you by email or through your affiliate dashboard and update the "Last updated" date at the top of this page. Your continued participation in the Program after the revised terms become effective constitutes your acceptance of the changes. If you do not agree with any modification, you may terminate your participation in the Program.

10.2 Relationship of the Parties

You and eSimHero are independent parties. Nothing in these Affiliate Terms creates a partnership, joint venture, employment, or agency relationship between you and eSimHero. You have no authority to bind eSimHero or make commitments on eSimHero's behalf.

10.3 Assignment

You may not assign or transfer your rights or obligations under these Affiliate Terms without eSimHero's prior written consent. eSimHero may assign its rights and obligations under these Affiliate Terms at any time without notice.

10.4 Severability

If any provision of these Affiliate Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10.5 Entire Agreement

These Affiliate Terms, together with the general eSimHero Terms of Service and Privacy Policy, constitute the entire agreement between you and eSimHero regarding your participation in the Program.
